Scott Daniel
Scott Daniel has been practicing law for over forty-five years and is currently licensed in Nebraska, Iowa and Arkansas. He has been associated with Gettman & Mills LLP on an “Of Counsel” basis since 2012, providing general legal advice and civil litigation representation to both individuals and businesses.
Mr. Daniel completed his undergraduate studies at Iowa State University and the University of Nebraska-Lincoln in 1972, graduating from the University of Nebraska College of Law in 1975.
From law school, he joined the multi-state law firm of Nelson, Harding, Marchetti, Leonard and Tate in its Lincoln and then Omaha, Nebraska offices as an associate and then partner. He concentrated his practice on representation of motor carrier transportation clients before the Interstate Commerce Commission and State regulatory bodies on interstate and intrastate transportation operating authority and rate matters, as well as general civil litigation matters in State and Federal Courts.
In 1981, Mr. Daniel joined Denver Southwest Express, Inc., a motor carrier based in Little Rock, Arkansas as its Vice President and General Counsel. He was responsible for all company legal matters including employment disputes, insurance and contract negotiations, accident and liability representation, rate and business relationship negotiations and agreements and regulatory compliance.
In 1983, Mr. Daniel again entered private practice with the firm of Hilburn, Calhoon, Harper, Pruniski and Calhoun, Ltd. in North Little Rock, Arkansas as associate and partner. He continued his representation of motor carriers before Arkansas State and Federal regulatory bodies as well as general civil litigation, including business and contract disputes, employment claims, construction, personal injury and transportation injuries. However, the primary focus of his practice now revolved around securities litigation and arbitration before the New York Stock Exchange and National Association of Securities Dealers. As Arkansas counsel to several large nationally recognized broker-dealers, Mr. Daniel’s practice included the general civil litigation defense, defense of investor claims of fraud and mishandling of securities and commodities accounts along with and broker contract disputes and related employment claims.
In 1997, Mr. Daniel returned to Nebraska and joined Brashear LLP (formerly Brashear & Ginn) in Omaha. While still practicing general civil litigation for clients in Nebraska and Western Iowa, the bulk of his practice now included the representation of Nebraska counties and the governmental risk management association (NIRMA) in litigation involving civil rights claims, prisoner rights, personal injury, construction and eminent domain.
In 2012, upon joining Gettman & Mills LLP as of counsel, he has continued his general individual and business practice, including insurance defense, personal injury, employment disputes, transportation, construction and litigation of business disputes and contract claims.
